Key Changes in CAWR 2006 13th November 2006

New regulations were required to implement amendments to the European Asbestos Worker Protection Directive (AWPD) and other changes to the existing asbestos regulatory framework. Prosections News

The HSE is now enforcing all aspects of the Control of Asbestos at Work Regulations 2002, including Regulation 4. A sample of this year’s prosecutions:

Sheffield Crown Court, April 05 - Total fines and costs £11,751.
Demolition of buildings containing asbestos cement sheeting. Contamination left on site. No attempt to prevent spread of contamination. Breach of CAWR no 15.

Leamington Magistrates Court, April 05 - Total fines and costs £5,612.
Company failed to minimise the spread of asbestos when a gym/shop unit was being converted into a restaurant. A director was made aware of the presence of asbestos ceiling tiles by a licensed asbestos contractor, who quoted £17,000 for its removal and other refurb work. Within a month of this a non-licensed individual removed the asbestos material, creating asbestos contamination both inside the building and outside. Breach of CAWR no 15.

Birmingham Magistrates Court, March 05 - Total fine and costs £18,582.
Uncontrolled accidental release of asbestos dust during a plumbing job. I worker and at least one member of public was exposed to the dust. Ineffective measures to control further exposure & spread of contamination. Breach of CAWR no 14 and no 5.
